General Terms and Conditions AGB

The business relationship between you, our valued customer, and us gives rise to rights and obligations on both sides. These are set out below.

1.0 Scope of application

When placing an order, making a purchase or using the website www.daniele.shop (hereinafter: online store), the General Terms and Conditions of Daniele Gaumenschmaus GmbH (hereinafter: Daniele) come into force.
The GTC govern the relationship between the orderer, purchaser or user (hereinafter: customer) and Daniele Gaumenschmaus GmbH, 8200 Schaffhausen.

If the customer is resident in Switzerland or the Principality of Liechtenstein, they are welcome to place an order in the online store.

The payment and delivery conditions and the right of return are an integral part of the GTC.

2.0 Offer

The products and services in the online store are available as long as they are visible in the online store. The images serve to illustrate Daniele's products or services. The explanations and information serve to explain which product or service is involved. It is clear to the customer whether the content viewed is of an informational or offer nature. An offer includes a product with the „add to shopping cart“ button.

2.1 Prices

The prices published in the online store are net prices in Swiss francs (CHF) including VAT and apply to the products or services published by Daniele.

Postage and handling charges are not included in the prices displayed and are shown separately in the shopping cart.

3.0 Order

The customer selects the desired products from the offer by clicking on the „Add to shopping cart“ button. The customer specifies the desired quantity. The default setting is always one (1). Daniele reserves the right to accept an order.

3.1 Ordering process

The customer places an order by following the wizard in the shopping cart and completing it by clicking on „Send order“.

3.1.1 Billing address and delivery address

The customer enters their valid billing address in this form. The delivery address can be specified if it differs from the first address. Both addresses must be in Switzerland or the Principality of Liechtenstein. P.O. Box addresses cannot be used as delivery and/or billing addresses.

3.1.2 Shipping method

The optimum shipping method can be selected here. The customer should note that this service is subject to a charge, but is free of charge from a certain order value. The first delivery is usually made with a parcel against signature.

When processing dispatch lists, the postage incurred will be charged at cost price. The customer requests a quote.

Subsequent deliveries are free of postage and handling charges.

3.1.3 Payment method

The customer can choose a suitable option from the following payment methods:

  • Cash payment on collection
  • by prepayment
  • via Stripe online payment service ®
  • against invoice (except for the first order)

3.1.4 Testing and sending

The „GTC“ checkbox must be ticked to complete the order so that it can be validly sent. The order becomes binding. The goods will be delivered according to availability.

3.1.5 Invoicing

The order total of the order confirmation is invoiced. The order total is shown in Swiss francs (CHF) and includes packaging, postage, processing fees and VAT (hereinafter: the invoice). The customer receives an automated order confirmation by e-mail. The paper receipt is enclosed with the package of goods.

4.0 Terms of payment

The invoice can be paid according to the option set.

Unjustified deductions will be charged subsequently; third-party charges for payment transmission should be avoided. Address searches are subject to a charge of 50.00 Swiss francs (CHF). Customers outside Switzerland can request a prepayment invoice.

The invoice is to be paid in Swiss francs (CHF). Customers outside Switzerland pay their invoice in euros (EUR) to a specially designated account.

4.1 Transfer of ownership / risk

The order becomes the property of the customer after full payment of the order total. External damage to the goods package must be documented by the customer.

4.2 Default of payment / refusal to accept the parcel

Reminder and collection fees shall be charged to the customer for late payments. Interest on arrears of five (5.0) percent per annum shall also be charged from the due date of the invoice.
If the customer refuses to accept the parcel upon delivery, fifteen (15) percent of the invoice amount will be charged as a cancellation fee, but at least CHF eighteen (18.00).

5.0 Withdrawal

Daniele grants a right of withdrawal of fourteen (14) days. Daniele must be informed of the withdrawal
The customer may exchange the products within fourteen (14) days. After the above-mentioned period, the order acquires the status of a purchase contract in accordance with the Swiss Code of Obligations.

Whether withdrawal or exchange, the goods must in any case arrive at Daniele on time, in their original packaging and without signs of use, and packed securely for transportation. The customer can return the goods themselves in the store or pay the postage themselves.        
In the case of unstamped or insufficiently stamped returns or exchanges, Daniele may refuse to accept parcels if they are damaged in transit.

Vouchers and bookings of services are excluded from the right of withdrawal and exchange.

5.1 Transport damage

If delivery damage has occurred despite transport-safe packaging, the customer shall report this immediately to the responsible delivery agent and have the damage documented. After receiving the documentation from the deliverer, Daniele shall provide compensation.

5.2 Complaints / notices of defects

Complaints and notices of defects shall be reported by the customer within five (5) working days. For this purpose, the customer shall use either e-mail or telephone: mail@shop-daniele.ch or 052 625 82 70. After the inspection, the customer shall be informed in writing of the appropriate measure. The customer has the right to a replacement delivery or a price reduction.

6.0 Liability

The customer chooses the products himself. He is aware of their use and application and declares himself responsible for them. The customer is aware that red and white wine may only be ordered and consumed by customers over the age of sixteen (16) and grappa only by customers over the age of eighteen (18). Daniele will ask the customer to confirm their age.             
No rights to compensation can be derived from an error in explanations, information, illustrations or product presentations. No liability is accepted for indirect or consequential damage. Gross negligence or intentional damage must be proven to Daniele. Damage caused by a third party that disrupts the contractual relationship between the customer and Daniele is also excluded from liability: in particular, but not exhaustively, „attacks from the Internet“ are mentioned.

7.0 Applicable law

The General Terms and Conditions are subject to Swiss law. Unless otherwise agreed in writing, the place of jurisdiction is the registered office of Daniele in Schaffhausen.
